Terms & Conditions

These Terms (including our Privacy Policy and Returns Policy) apply to your use of our website (www.wally.co.nz), your interaction with our brand, and any purchases made online or in-store. By using the site, browsing products, or placing an order, you agree to these Terms. If you don’t agree, please don’t use the site or purchase from us.

In these Terms, “we”, “us” or “WALLY” refers to WALLY Limited. “You” refers to our customers, site users or visitors. “Website” refers to www.wally.co.nz and any content accessed through it.


1. Order Acceptance

Placing an order on our website is an offer to purchase. You’ll receive an order confirmation email once we’ve accepted your order - only then is a contract formed. Orders are subject to availability, and WALLY reserves the right to limit or cancel orders at any time for any reason, including but not limited to suspected commercial use or stock issues.

We’re a direct-to-customer retailer and don’t accept bulk orders or orders from resellers, exporters, or wholesalers. Orders that appear to be for resale may be cancelled at our discretion.

If a product is unavailable after your order is confirmed, we’ll notify you and issue a refund for the unavailable items. Refunds will go back to your original payment method.


2. Pricing

All prices listed are in New Zealand Dollars (NZD) and include GST. Prices are subject to change without notice. The price charged is the one confirmed at the time of order, unless an error has occurred.

Prices online may differ from prices in-store. Promotions or discount codes may be valid online only unless otherwise stated.

If your order includes shipping, duties or taxes, those will be clearly outlined during checkout. For now, WALLY only ships within New Zealand.


3. Payment

We accept payment via Visa, Mastercard, American Express, Apple Pay, Google Pay, Shop Pay and Afterpay. All online payments are processed securely using SSL encryption.

Full payment is required at checkout. Orders will not be dispatched until payment is successfully processed. If your payment fails or is declined, your order will not be completed.


4. Shipping & Delivery

We ship within New Zealand only. Orders are generally dispatched within 1 business day. Delivery time is usually 1–3 working days (rural areas may take longer). We use tracked courier services and will send you a tracking link once your order is on the move.

  • Standard Shipping: $6.95 flat rate for orders under $50
  • Free Shipping: Orders $50 and over

WALLY is not responsible for delays once your package is in the courier’s hands. If your parcel is lost or delayed, we’ll help you chase it up - but we’re not liable for losses caused by delivery delays or errors.

We don’t currently deliver to PO Boxes. Please provide a physical address where someone can receive the parcel. If you choose "no signature" delivery, you accept full responsibility for the package once the courier marks it as delivered.

Click & Collect will be available from our Takapuna store once open (October 2025). You’ll receive an email when your order is ready for pickup. Orders not collected within 14 days may be cancelled and refunded.


5. Returns & Exchanges

We want your WALLY purchase to feel right. If it’s not quite working out, you can return your order within 30 days for a refund or exchange - no hard feelings.

Return Conditions

  • Items must be unworn, unwashed, and in original condition
  • Tags must be attached
  • You must provide proof of purchase (loyalty members usually won’t need this)

Items not eligible for return:

  • Final Sale items (clearly marked at checkout)
  • Underwear
  • Socks
  • Earrings

You can return in-store at our Takapuna location or via courier. To return via courier, email help@wally.co.nz with your order number and reason for return. Return shipping is at your cost unless the item is faulty. Original shipping charges are non-refundable.

Refunds will be processed to the original payment method within 3–5 business days after we receive and check the returned item.


6. Faulty Items

If you receive an item that’s faulty or not as described, we’ll sort it out as quickly as possible. We comply fully with the Consumer Guarantees Act 1993. If your item is deemed faulty, we’ll offer a repair, replacement, or refund.


7. Gift Cards

Digital gift cards can be purchased online and used in-store or online. Gift cards do not expire and cannot be returned or redeemed for cash. Treat your gift card like cash - we’re not responsible for lost or stolen codes.


8. Promotions & Discounts

Promotional offers are valid only during the advertised timeframe and while stock lasts. Discount codes must be entered at checkout and cannot be applied retroactively. Unless otherwise stated, promotions cannot be combined with other offers. Any refunds will match the price paid (not full price) at the time of the original purchase.


9. Intellectual Property

All content on our website - including logos, text, product descriptions, photography, and branding - is the property of WALLY or our licensors. You may not copy, reproduce, or use any material from the site without permission.


10. Privacy

We care about your data and how it’s used. Our Privacy Policy explains what we collect and how we use it. We’ll never sell or share your personal info without consent, except where required by law or necessary to complete your order.


11. Accuracy of Information

We do our best to ensure that all content on our website is accurate and up to date. However, we’re human, and sometimes errors may occur (pricing, product availability, or descriptions). If we spot an error in your order, we’ll let you know before shipping or processing payment.


12. Limitation of Liability

To the fullest extent permitted by law, WALLY is not liable for any loss, damage, or costs arising from the use of this website, including direct, indirect, incidental, or consequential loss. We’re also not responsible for third-party links, external content, or delays beyond our control.


13. Governing Law

These Terms are governed by New Zealand law. Any disputes will be resolved in accordance with NZ legislation.


14. Updates to Terms

We may update these Terms occasionally to reflect changes to our services, policies, or legal requirements. The version on this page is the most current. Continued use of the website indicates your agreement to the updated terms.
